Divorce lawyers have noticed an increase in the number of times Facebook, texts, and instant messaging are mentioned by clients when discussing their divorce cases. In fact, according to Divorce On-line, a family law firm in the UK claimed that almost one in five divorce filings cited Facebook in their petitions.

Divorce lawyers and their clients have been using social media sites to find incriminating evidence. An excellent example is a wife seeking a job on Linked In or Craig’s List after reporting to the courts that she is not able to work. Facebook pictures tell interesting stories about girlfriends taking trips with their married boyfriends. These expensive vacations can translate into found money for the divorcing spouse – the funds used can be considered a marital asset.  It has been my experience as a Chicago divorce attorney that most clients benefit from utilizing guidelines and maintaining caution when posting on Facebook in order to minimize documents that may be used in court.

According to an April 2010 article, titled “Facebook to Blame for Divorce Boom”, foxnews.com reports “the dangers of social networking sites for the young are well documented, but increasing numbers of middle-aged users are also having their private lives thrown into turmoil by online activity.” Again, my advice as a Chicago divorce lawyer, use good judgment when using Facebook and other social networking sites.
